The Association Law Firm routinely enforces covenants and rules for its association clients. When handling covenant enforcement matters for a client for the first time, the Firm will initially review the governing documents of the association to determine the applicable restrictions and procedures of enforcement. Depending upon the specific needs of the Association, the Firm will send violation demand letters, send mediation demand letters, file a lawsuit, or file an arbitration proceeding to enforce the covenants and rules of an association. The Firm encourages the informal resolution of covenant matters and often suggests meetings between the board and owners to cure violations short of costly litigation. The Firm will assist the association in all aspects of this process, including performing on-site inspections and providing recommendations regarding the property in violation. |
